Can an Employee Claim Leave Encashment and ESIC Reimbursements After Maternity Leave?

One of your employees has been working for the past four years. She went on maternity leave in January 2012 and delivered in February 2012 at a government hospital. Due to some health problems, she could not rejoin the company on time. She has rejoined in December 2012.

Leave Encashment and Reimbursements Under ESIC

Now, can she apply for leave encashment or any reimbursements under ESIC? Is there a specific procedure for this? Please advise accordingly.

As per the Maternity Benefit Act, 84 days of leave can be taken. After that, for the next 15 days, maternity leave can be taken with a doctor's certificate. Furthermore, based on the health conditions and advice provided by a government doctor, she may be eligible for the remaining months as well. The main issue arises when it comes to ESI reimbursement, as it is applicable for only 1/4th of the salary.
