Gratuity in Manufacturing: Is 4 Years and 10 Months Enough for Eligibility?

If an employee in the manufacturing industry works for four years and 10 months, is he eligible to get his gratuity? Please give your valuable suggestions.

Eligibility for Gratuity Payment

The employee who worked for 4 years and 240 days in the 5th year of service is eligible for the payment of gratuity. However, it shouldn't be overlooked that in each year, the working days must be 240 days because 240 days equal 1 year of service.

Thank you so much for your information. But where did you mention that 240 days of service in the fifth year are enough to be eligible to receive gratuity? When I went through the act, it clearly states that the candidate should complete five years compulsorily. However, in one case in Tamil Nadu, the Madras High Court issued an order as you mentioned. Should we consider that order as a reference for determining an employee's eligibility?

Our factory is located in Andhra Pradesh. If there has been any judgment passed on this matter, please provide me with the details for reference.
