Maternity Leave and Work Benefits: How Does It Affect Your Paid Leave and Bonus?

Dear Seniors, Will Maternity Leave be considered as working for the purpose of the following:

1. Calculation of PL/EL for the period of 12 weeks maternity leave. Will the full 15 PLs be allowed in such a case, or reduced for the 12-week duration of maternity leave?

2. Calculation of Bonus for the period of 12 weeks maternity leave.

Maternity Leave as a Benefit

ML is not considered as leave. It is a benefit irrespective of actual physical absence from duties.

1. Are you under the Factories Act or what act?
2. Is the employee covered under ESI?
3. Did she actually avail the leave, or is it a special case?

As per the Bonus Act, if an employee worked more than 30 days, then they are entitled to receive the bonus for the financial year. Maternity leave dates should be excluded from the mentioned leaves.

The same principle applies to calculating the leaves for a calendar year.

ML is considered a working day, as rightly said by Mr. Khola. It should be treated in the same way as Privileged Leave, which is also considered a working day for all purposes.
