Navigating Family Pension and Insurance for a Freelancer's Family After His Passing

My son had worked in a few companies before he passed away in the year 2009. He had not withdrawn his PF amount. However, he was working as a freelancer for an HR Company, and no PF contribution was being deducted from his pay. I presume this would be treated as 'death away from service'.

In this case, kindly advise me whether his widow and minor child are entitled to family pension and insurance benefits.

I am very sad to know this. The answer is yes. Please approach the PF Regional office with your concern; I am sure they will assist you in this matter.

Pension Details for Widow and Child

The widow's pension for a salary of Rs. 6500 and above is Rs. 2051, and the child pension is Rs. 513, as per Table C. If the salary is below Rs. 6500, kindly inform so that the corresponding pension amount can be conveyed. Apart from this, the nominee is entitled to get EDLI from PF.

I am really sorry to know about it. In case you do not get cooperation from the office, then fill out an RTI (Right to Information Act) form with details of the PF number and pension number of your son and submit it to the respective PF office where your son is covered.

You can also register your complaint on the EPFO Grievance portal at http://epfigms.gov.in/ and contact the CPFC - the Central Provident Fund Commissioner at the following address:

My sincere condolences to the members of your grieving family. As my friend suggested, apply using Form 5(IF) to claim the EDLI, which is up to Rs. 100,000 (maximum amount), depending upon the balance in your late son's PF account. Ask your daughter-in-law to apply using Form No. 20 for the PF claim and Form 10-D for the pension.

If the child is a minor, only one set of forms is enough. If the child is a major (above 18 years), you have to submit a separate set of Form 10-D. The forms have to be attested by his ex-employer. Kindly contact the concerned PF office; they will help you and your family. If you need any help, kindly write to us; we will be with you all.

It is not on your basic salary of Rs. 6500/- that the EDLI will be paid. If your PF balance, both employers' and employees' contributions combined, is more than Rs. 50,000/-, they will pay you a minimum of Rs. 50,000 and the remaining 50% of the balance amount (both employer and employee contributions) up to a maximum of Rs. 1.0 lakh.

While the thread initiator's primary query/concern seems to have been addressed by G.K. Manjunath and others, I don't see any further contribution that I can make. However, I really can't desist from commenting about the ready responses with personal intervention assurances that came from the members. I think this is what makes CiteHR really unique—having seen similar threads earlier. Frankly, a TRUE example of EMPATHY rather than sympathy and proof that members don't have just the brains to give very valid and realistic advice but also exhibit their ability of 'thinking through the heart' when the need arises.

@ Prema Kumari—while joining other members in wishing that your son's soul rests in peace, you can surely depend on this forum to give you the much-needed advice/support to mitigate your problems.

In case of death, a member should receive 20 times their average salary on which contributions were made for the year in which they passed away. This means that if their PF has been deducted assuming Rs. 6500/- per month, then 20 times, i.e., Rs. 130,000/-, should be paid by the PF Department to their legal heir.

Kindly go through the Employees' Pension Scheme - 95, which can be downloaded from EPFO. Table C stipulates the corresponding slabs for various salary ranges.

If the employer has deducted and deposited PF, and the member has not yet withdrawn his PF accumulations and has passed away irrespective of the workplace, his legal heir will surely receive all the benefits, namely PF accumulations, Pension, and EDLI claim.
