Suddenly Let Go as AGM: How Can I Seek Fair Compensation from My Company?

aishwaryasuresh2000
I have been working with a well-known company based in Chennai, and I work in Bangalore as an AGM for this organization. All of a sudden, my chairman called me last night and informed me that they no longer require my services. I requested two months' compensation to leave, which they are not willing to provide. The reason cited was their dissatisfaction with my performance. I have only recently rejoined them, just two months ago, and it seems unreasonable for the company to expect significant performance improvements in such a short time.

Seeking Advice on Pursuing Compensation

Can somebody advise me on how to pursue compensation from the company?

Thanks and Regards,
Suresh

I second Sateesh. Your appointment letter mentions the clause of termination during probation. Please refer to that. You will be able to present your case better.

Were you informed about your performance before the final meeting? What was that communication all about? Did they offer you any support to improve your performance?

Do not mention that you just joined 2 months ago. I was surprised after seeing your posting because you are in the AGM cadre. Try to speak with the chairman and promise him that the management will be satisfied with your performance in a month. Meanwhile, ask him what they are expecting from you.

In addition to the response and question above, let me add one more question: Are they asking you to resign or terminating you by stating the reason of poor performance? If they are asking you to resign from your position, please do not resign and let them take action at their end; that is what you have to do and remember first. Second, if they are proceeding to terminate you for poor performance, they have to follow the terms and conditions stated in the employment/appointment letter. If the respective conditions allow them to terminate you, they can, but certainly can't terminate you immediately or without giving you any warning letter/notice in this regard.

Dear Suresh,

I am neither an HR expert nor a lawyer. Others have offered you some advice based on your account. However, to me, what you have written is not entirely clear. Hence, let me ask you a few questions.

Clarification Needed on Employment Details

How long have you been working for the company? What does AGM stand for (Please excuse my ignorance.)? When you mention "I have just joined them back 2 months," do you mean you started working with the company two months ago? If so, what is your probationary period?
