Our company is a joint venture group (50:50) with participation from abroad. In this connection, the foreign company wants to send its personnel to India to advise us. They will be coming under a business/work visa and will stay for longer periods.

What are the formalities to be completed by them in India and abroad? The complete formalities to fulfill to get a visa for them from abroad and the stay formalities in India for two years.

The salary for them will be paid by the joint venture in Europe. Please help me with this matter or provide names of some consultants.

This should be carefully done, and employees may face legal actions if not done properly. There are a lot of formalities as listed below:

1. FEMA
2. PF
3. Income Tax
4. Intercompany charges
5. PE issues (permanent establishment)
6. VISA
