Facing Legal Threats After Skipping Notice Period: What Are the Real Consequences?

Hello Everyone,

One of my friends is in a situation where he left his previous company by giving them a resignation, but he did not serve the notice period, as his present company has assured him they would provide an experience letter from their company. Now, the previous company is sending him a show cause notice. Up till now, they have sent him three notices and also an amount he has to pay as a recovery amount. They have also warned him about taking legal actions.

I wanted to know what would happen if he ignores it and does not pay the amount. Or if he does not go back and does not serve the notice period, what will be the previous company's next step? Will they take any legal action?

If the company is organized, there is surely legal action that will follow, as I assume this clause will be mentioned in the Offer/Appointment letter, which needs to be signed and returned to the organization once/before he joins.

In most cases, the company will find it very expensive to recover the notice pay. Let him take the help of his existing company to decide what response he should give.
