Legal Considerations for Part-Time Technician Appointments

If a corporate hospital appoints a technician (lab/x-ray, etc.) on a part-time basis, hourly payment basis, or work basis to avoid full-time employment and to evade all labor issues, what legal issues are involved in this? What are the statutory obligations? What should the contract contain? Can his appointment be treated as a "Consultant," and honorarium will be paid to him?

Part-Time Employee Coverage

Part-time employees are also covered by all statutory and social welfare schemes like ESI and EPF. They are also to be paid a salary at the rate of minimum wages fixed by the government, but it can be proportionately reduced based on the hours worked.

Consultant vs. Technician

A consultant is normally a highly skilled person, and an X-ray technician is not like that. If you give an appointment order as 'consultant,' it will not be fair.
