Since yours is an industry, the ID Act will apply if you have 'workmen'. The EC Act will also apply if you have 'employees' defined under the Act but not covered under the ESI Act. If you have 'contract laborers', the CLRA Act is applicable. There are registers, returns, and reports under all applicable Acts. Ms. Basima can help you since you are in Kochi.
IT firms are not under the Factories Act for the time being. A case is pending in the Supreme Court on whether IT activities constitute a manufacturing process or not. In a case under the ESI Act, the Bombay High Court held in July 2012 that it is a manufacturing process, and IT firms are considered factories for ESI purposes. It is advisable to wait for a similar decision under the Factories Act. Until then, IT firms fall under the purview of the Shop & Commercial Establishment Acts of the respective states.
