Strategies for Responding to Labour Inspector Compliance Issues

Labour inspector visited our factory in October. At that time, HR activities were being handled by the Accounts person who was not aware of the legal requirements outlined in the act and has not yet responded to the inspection report. Fortunately, the inspector has not taken any action to date.

I have recently joined the company and now have the responsibility of managing all the requirements, from attendance to license renewal. I need to know how to respond to the inspector promptly.

Please advise.

Has he given any inspection report? Generally, when an inspection takes place, the inspection report would be noted down in a book or document of your establishment. Thereafter, notices would be issued for non-compliance. If no such thing has happened, you are not required to give any reply.

At the time of the inspector's visit, no remark was given by the inspector because we had not maintained any inspection register. However, after a few days, he sent us copies of printed inspection remarks. Please guide.

His remarks are as follows under the Minimum Wages Act: not maintaining muster roll cum wage register, abstract of the Act, and rates of wages paid to the workers are not as per the minimum rate of wages.

Under the Contract Labour Act: renewal of the license is not done, muster roll cum wage register in form II, and rates of wages paid to the workers are not as per the minimum rate of wages.

You can send a communication to the Inspector stating that you have recently taken up the job, have reviewed the remarks, and have begun taking steps to comply with them. You can also mention that you will report compliance within a specified time and conclude by thanking him.

Dear All,

In case the registers are not maintained from the date of registration but covered under ESI and PF, what can we do now? Should we maintain every record from the date of incorporation, or is there any other way? If so, please guide me. Please help me solve this issue.
