How to Write a Declaration Letter for PF Withdrawal When Transfer Isn't Possible?

Dear HR professionals, One of my employees, who joined us on September 15, 2012, has her PF account in her previous company, Adobe. She now wishes to withdraw her PF from Adobe as it is not possible to transfer the amount. Therefore, she requires a declaration letter from our side stating that we do not have any provision for a PF Account. Could you please provide the format for the same?

PF Account Withdrawal and Transfer Rules

As per the Act and PF rules for any PF account withdrawals, a PF member should declare that: "I declare that I have resigned and am not employed in any factory/establishment to which the EPF scheme applies for a continuous period of not less than 2 months immediately preceding the date of my application for final withdrawal of my provident fund money (PF Form-19)." According to the above rule, no PF member can work in any PF-covered factory/establishment within 2 months from the resignation of the PF account. However, this rule has not been implemented in any establishment, and PF authorities are not particular about enforcing this rule. Therefore, in response to your question, there is no need to give a separate declaration as it is already included in the withdrawal Form-19.

Question on PF Transfer

My question is, why do you think a transfer is not possible? Generally, a transfer is possible. Transfer is the actual rule of EPF when any person changes employment.

Actually, a transfer is not possible because my company is at a very small level. We do not have a PF account system. Therefore, my employee needs a declaration from our side stating that we do not have any PF account system in our company.

Ok. However, I think she only needs the form signed by her former employer. There is no provision for the new employer to sign in case of a withdrawal.

You simply have to fill and file Form No. 19 and Form 10C by obtaining the signature of your previous employers. Also, enclose Form No. 5 and Form No. 10 from your previous employer.

Mr. Ramanarayan is right. The employee does not need to enter in Form 19 that she is working with you. She must submit the form after 2 months declaring that she is not employed in any establishment under the PF scheme.

No need to declare anything except the declaration mentioned in Form No. 19 for the withdrawal of PF money. Simply fill out Form No. 19 and get it attested by the employer of the firm in which you have been a member of PF.
