Expanding Our Real Estate Branch in Mumbai: Do We Need a New Shops & Establishment Certificate?

Dear Seniors, I need guidance on the matter below. Our real estate consultancy has been located in Mumbai for the last 5-6 years. We have a Shops & Establishment certificate that needs to be renewed this month as we are registered.

Branch Expansion and Certification Query

This year, we have opened a branch in another suburb of Mumbai. Do we need to apply for a new certificate under the same company name for this branch, or should we add the branch address at the time of renewing the current certificate?

Though you are carrying on the same business but at different premises and not at the main establishment, in my view, you need to apply for registration of the new premises under the Bombay Shops Act.

Though it is a sister concern or a branch office in the same city, as per the Shops & Establishments Act, it has been enacted that the employer needs to apply for a new registration based on the specific number of employees.

Registration Requirements Under the Bombay Shops Act

Under the Bombay Shops Act, there is no condition regarding employing any person to apply for registration. Even if the employer is the only one present in the branch, registration is still required.

Each unit of the same establishment working at different locations needs to have a separate license for each unit.

Under the Bombay Shops and Establishment Act, a fresh license is required for every shop and establishment under Section 7 of the Act.
