Is ESI Deduction Mandatory for Our 100+ Employee HR Consulting Firm? Seeking Advice

Dear All, Ours is a 100+ employee HR consulting organization, and we have employees ranging from Trainees to Manager level. Is it mandatory to have an ESI deduction? Our organization has been in the industry since 2008, and no ESI deductions have been made in all these years. However, the employees do have a PF deduction on a monthly basis.

Kindly advise if ESI can be waived off.

If your establishment is in an ESI-implemented area, you should have ESI coverage. Please verify if your area is an ESI-implemented area. If so, your coverage will take place retrospectively from the date on which the employees on your rolls became 20. Now, the threshold limit is only 10.
