Confused About My Paid Leave and Salary Deduction – How Should I Address This with HR?

Hi All, Good day! I have been working in a Pvt. Ltd. company for the past 8 months (I joined in April). Last month, I took a two-week leave to prepare for my MBA entrance exam. I received my October salary before the Diwali holidays.

Leave Entitlement and Usage

As per the appointment letter, I am entitled to a maximum of two paid leaves per month after 3 months of probation. Based on calculations, I should have received 8 paid leaves from July to October.

During my time with this company, I have taken a total of 13 leaves from July to October (after the probation period), which breaks down as follows: July - 0, August - 0.5, September - 1, October - 11.5. By the end of October, I had accumulated 6.5 paid leave days.

Salary Discrepancy

The pay I received in October was for 19.5 days, while I should have been paid for 26 days (11.5 days of leave in October minus 6.5 paid leave days). I informed the Receptionist, who also handles HR, about this discrepancy. She mentioned that it is now too late to make changes due to PF/ESI being closed and that altering it could affect the accounts for the remaining months. Is this true?

She did assure me that she would investigate. However, for the past three days, I have been inquiring repeatedly, but she keeps delaying it, providing various excuses (like the computer is not working).

I would appreciate your guidance on what steps I should take next.

Options for Managing Leave Discrepancies

Availing the remaining leaves is the best option for you. There is something wrong with your paid leaves; please get it corrected by the HR department. As the ESI/PF deduction has already been processed, there is no chance of changing it again. Therefore, you can adjust your next leaves manually.

Check Your Remaining Paid Leave Days

Have a check with your HR person to see how many paid leave days are still remaining. If you are absent for more than 3 days, then paid leave should be considered. You are paid for 19.5 days, and you were absent for a total of 13 days. Based on your date of joining, you are eligible for 7-8 paid leaves (it depends on the date you worked until in October before taking leaves). If we consider 8 days of paid leave for your 13 days of absence, then you should be paid for 21 days (as you were paid for 19.5 days). The remaining 1.5 days of leave can be utilized on any future days.

Salary and Leave Encashment

Once the salary is generated and payment is made to PF & ESI, there is no opportunity to change it again. In the meantime, it's advisable to utilize your remaining leaves instead of opting for encashment.
