How Many Leaves Are Contracted Office Employees Legally Entitled to Each Year?

I am new to this forum, and I wonder if someone can help me with the following query. I would like to know how many leaves are eligible for contracted office employees (i.e., peons or drivers) during the year as per the law.

For contractual employees, the eligibility for leaves is 1 day for Casual Leave (CL) and 1 day for Sick Leave (SL) per month. Contractual employees are not eligible for leave encashments. There is no carry-forward process for these employees, and in case no leaves are taken, they can be adjusted against the waiver of the notice period.

Leave Eligibility for Contracted Employees

If the employees are engaged through a contractor, he shall allow them leave under the law applicable to him. It is not your liability. Instead, if they are your employees, they are eligible for leaves at rates applicable to regular employees or at the minimum statutory rate.

Employees under contract or company roles are entitled to leave. One day of leave for every 20 days is the entitlement under the Factories Act. Apart from this, Sick Leave (SL), Maternity Leave (for married females), and Casual Leave (CL) are also applicable but are restricted by conditions. More importantly, leave is to be treated as a privilege and not a right.

He is a contractual employee working in an office. We have a factory manufacturing steel, but it is located at another place.

Hi all members, I think it's my first time joining this forum. What kind of employee is that? A driver? If so, then the number of leave days depends on the contract. One year has 22 working days of leave.

As per the Factory Act, you should pay one day's leave for every 20 days worked. No other rule is applicable for leave. However, all companies set up their own norms for casual leave, medical leave, compensatory off, etc., which have nothing to do with the law.
