Stuck in a Job Bond: Can I Legally Leave When My Salary Is Delayed?

amit12451
I am working with a software company. I have signed a bond with my company, but for the past year, I have not been receiving my salary on time. Additionally, we do not have any legal processes like P.F in our company. When I mentioned to management about leaving the job, the company is blackmailing me by threatening to file a case against me. I cannot work in such an environment. Please guide me on what I should do in this situation. Should I break the bond or not?

Legality of Employment Bonds

Also, I read on the HR site that bonds are illegal according to the labor act. Is this true or not? Please advise me on what steps I should take.

Looking forward to hearing from you.

Regards,
Amit

Understanding Bond Agreements

What type of bond is it? Each bond has an exit clause with its related terms and conditions. Any bond or agreement that is one-sided is bad in law. How many employees have signed the bond in your organization, and what has been the management's reaction when they left the job? Until you send the details of the bond, it will be very difficult to help you.

Please go through this thread about Bonds – a pretty detailed one that could be covering your situation too: https://www.citehr.com/423676-legali...anisation.html. Please give more details about the Bond you signed – that will enable the members to advise you better and accurately. All the best.
