Dear Seniors,
Have a query on Leave Policy.
My company is allowing 36 leaves ( 24 - Privilaged Leave, 6 - Casual Leave, 6 - Sick/Medical Leave) in a calender year from January to December. The policy says that Privilege Leave can be availed for the minimum period of 3 days.
My question is if someone already avails all his SL & CL,but he has enough balance of PL. In an emergency he need a leave for 1 or 2 days, then can he avail 1 or 2 days PL or it will be consider as LWP(Leave Without Pay).

as per your policy, if you have the PL to be carry forward, then all ur PLs would be carried forward, provided you use atleast 3 PL in the whole period (calender year in ur case)
so you can use your 1 or 2 PL as reqd now and take 1 more towards year end... that solves ur problem... :-)
And dont worry it won't be considered as LWP. Your policy don't say you've to take min of 3 PL at a stretch... Chill...

My company policy says that one cannot take 1 or 2 days of PL, instead he can take CL or SL for that. Yes one can avail his PL at any time in a year, but it must be a minimum period of 3 days.

I still am unable to understand...
Most companies do have such clause but it is like you're suppose to avail min of x of leaves by the end of year...
If it is mentioned that you're suppose to take min 3 days PL and if they're forcing you take a 3 day's PL even when you need 1 or 2... be that... it wont be LWP

However my view is that if an employee has some kind of leave at his credit, you cannot treat him on LWP because LWP is resorted to only when an employee has exhausted all kinds of leave. The policy with regard to privilege leave as to it's restriction on minimum number of P.L to be utilised can be interpreted to be in force under normal circumstances i.e when an employee can have recourse to other kinds of leave i.e CL/SL etc.but not under special circunmstances like the one you have expalined. Furthet P.L is earned by an employee by putting actual servcie for prescribed number of days and thus is expected to have more libety in utilising it under special or compelling circumstances. The policy can be interpreted in a manner benficial to the employee aswell as to the company. This is in addition to the suggestion which Ankita gave which I find practicable.

This is as per the copmany policy. You can take acll on this. Like some companies just club all leave together and employee can avail anything from one to onwards.
