I worked at MIRC ELECTRONICS LTD as a service technician from April 1996 to March 2003 at the Chennai branch. I approached the EPF office for settlement. After repeated reminders, they settled a partial amount of Rs. 56,948 on 8.6.2004, which is only a portion of the original amount of Rs. 91,790. I then approached the EPF Kandivali for the remaining amount since 2003, but as of now, the amount has not been settled. In the meantime, I registered a grievance on the EPF website on 22/2/11 and finally received a reply on 17.10.2011. In the reply, the official stated that Form 19 had been settled for Rs. 56,948 via cheque no. 24583 dated 4.12.2003, and Form 10C had been settled for Rs. 34,842 via cheque no. 136166 dated 19.12.2003. My bank details are as follows: SB A/c No. 2147.
I believed their reply, so I approached the bank manager of MCC Bank. They informed me that until now, cheque no. 136166 has not been received by them and that they have written a letter to the General Manager of SBI Malad for details on the presented cheque.
I then registered the aforementioned grievance on their website again on 4.10.12. The registration number is SROKN/E/2012/06333, and I received an email reply from an EPF official stating, "This is with reference to your Grievance registered vide Registration Number SROKN/E/2012/06332. It is informed that after processing your grievance, the following action(s) has been taken: you are requested to write a letter for reissuance of the cheque and send the same to this office. You are also advised to get the letter duly attested by your ex-employer and to submit a cancelled cheque or other necessary proof establishing that you are the lawful legitimate claimant."
In this situation, can I approach the consumer forum for the remaining amount and compensation?
