Serving Notice Period Of 60 Days But No Salary Paid

Dear Members,

My notice period is 60 days from the date of resignation. I am serving the complete notice period and have resigned from my position in September. I am serving my notice period without salary. Officially, I will be released from this organization in Nov 2012, and despite requesting them many times to release my September salary at least, they refused.

They have an exit policy of which I was not aware until I joined. It is written that all payments will be on hold immediately after resigning. The HR executive says salary release before the full completion of the notice period would be a breach of company policy.

Apart from that, they will release my Full and Final settlement after 25 days of relieving.

Please suggest.

This may disappoint you, but many companies have this policy. You should have gone through the policies clearly before you resigned to plan out the various aspects of the process. I guess the only option you have is to plan out your expenses properly and frugally.

Yes, it's true that when you are on the notice period, the salary for that period will be paid in F&F. Most of the companies have opted for this policy.

Hi,

You can request them to shorten the tenure of F'n'F settlement, i.e., within 10 days instead of 25 days. Else, the exit policy of retaining all payments immediately after resignation is prevalent in many companies to ensure that the employee serves the full notice period. Just request or suggest to them that, as the breadwinner of your family, you cannot sustain without salary for approximately three months. Probably on humanitarian grounds, your reporting authority and HR can take the matter to management and make such an amendment.

Usually, most companies have such policies that employees are required to abide by. However, you can request the management to consider breaching the policy and amending it with immediate effect by providing specific reasons.

Thank you all for your valuable suggestions and for taking the time to read and respond. They have agreed to pay 50% of my one-month salary, and I am a bit happy as well.

One suggestion: Although they have a policy in place, no policy is above or higher than the law of the land. I have discussed this with a couple of my lawyer friends and with HR personnel as well. This practice is illegal.
