Understanding PF Withdrawal Form and DOJ for EPF Registration

loveneet
Hello Everybody,

Please let me know, if an employee was working in 2010 and the company is registered in PF from 2011, because of less manpower, then which date should be mentioned as the Date of Joining (DOJ) in the PF withdrawal form of that employee?

Thanks in advance. Waiting for your replies.

You have to mention the PF effective date as date of joining (DOJ) for those employees. PF effective date means the date your establishment or factory becomes subject to the PF definition.

Hello Loveneet,

As already mentioned by others, for existing employees, the DOJ will be the date your company is registered for PF. For everybody who joins after 2011, their actual DOJ.

Dear Friend,

The company was registered in 2011 for EPF, and the worker was in employment from 2010. The worker's D.O.J. will be the date of the allotment of the EPF code to the company. This is because prior to the registration of the company with EPF authorities, no deductions of EPF have been done for employees, nor have they been deposited with EPF authorities. Hence, his earlier service is not accountable for provident fund purposes.

Trust this meets your needs.

The date of joining in P.F will be effective since the date of eligibility in PF for existing employees on that date.

Resignation from service for a reason to withdraw an amount accumulated for an employee's old age is not a solution. He can take an advance against his PF accumulation as per PF rules if needed. Accepting his resignation for that reason also contributes to developing malpractice in society and entails a wrong interpretation of the law.

Deduction of PF is only based on the coverage of an establishment as per PF rules. Deduction will be made accordingly.
