How Can I Recover My Pending Salary After a Verbal Termination Without Documentation?

Rahil Rizvi
Hi, first time in my career, I got terminated from a job (three days after the completion of the probationary period). The employer terminated me verbally and didn't even ask me to submit a resignation. Anyway, I got a new job the very next day because of my profile. However, I want to recover my pending salary by asking them politely and by taking legal action. I need some support from forum contributors and experts.

Employment Status Uncertainty

1 - In that case, I am not sure, but I guess according to the contract letter, I am still an employee of the company because there is no resignation/termination document.

Communication with Employer

2 - With a positive mindset, I have started sending emails to my employer about the salary with the attachment of the previous balance salary email. (Salary for Sep 2012 and some balance amount of Aug 2012 salary).

Reminder Strategy

3 - I am planning to send a daily reminder email to the admin/accounts department or a person who handled finances and always asked for work reports during my employment. This is my positive way of getting my pending salary. (Will not send daily new emails).

Regards.

I am planning to send a daily reminder email to the admin/accounts department or the person responsible for finances who always asks for work reports during my employment. This is my positive way of addressing the issue of my pending salary. I will not send a new email daily but rather forward the same email with a copy of the last day's email. I am unsure if this approach will be beneficial in the future, especially if I decide to take legal action.

Questions About Termination and Legal Actions

Should I ask for the termination letter in person? If they refuse to provide a termination letter, should I submit my resignation instead? Is it legal to post a blog or review with attachments of emails and snapshots of the sent email folder on a personal website? I have kept records of all the emails I sent during my employment; will this be helpful?

Seeking Advice on Legal Proceedings

In addition to having positive discussions with them and sending daily emails, what else would you recommend in case they compel me to take legal action? How long does the legal process usually take until a final decision is made by a judge? I am unsure whether the final order will be given to me or my employer.
