Facing PF Withdrawal Rejection: How Can I Resolve This Issue with My Ex-Employer?

My previous employer was not willing to sign Form 19 as I had joined his competitor. Hence, I filled out both Forms 19 and 10C and submitted them to the Kandivilli PF office along with a complaint letter stating the above paragraph about my ex-employer not being willing to sign. After keeping my Form 19 for about 3 months, I have received a rejection letter with the Initiator's remark as "Double C pass" and the other reason as "Authorized sign attested on Form."

Guidance Needed on Next Steps

Please, can anyone guide me on what to do next?

You should attach the affidavit from a notary stating that you have no dues, and also mention your joining date and leaving date in it. Additionally, get your form attested by a gazetted officer and the bank copy attested by the bank. Then submit your form to the PF office.

Thank you for your prompt response. Please, can you clarify the following points from your reply:

1. By affidavit, do you mean an Indemnity bond wherein I will state that I have not withdrawn my PF amount to date and provide indemnity for the PF office?

2. Regarding the second point, do I need attestation from a gazetted officer and also from my bank manager as I will be resubmitting only one copy of Form 19 & 10C? Also, are you aware of a similar case that has been successful after following the above procedure?

Your photocopy of the passbook needs to be attested by the bank. An affidavit is a statement from a notary confirming that you were working in that organization. Unfortunately, your employer is refusing to attest your PF form without providing any reason. Your joining and leaving dates should be mentioned in the form.

You can also seek suggestions from the PF office.

If your present company has PF, why do you want Form 19? You can transfer the PF amount to the new company account by using Form 13.

You may raise a complaint with the concerned Regional Provident Fund Commissioner if your old employer is not signing your form. Follow it up with a reminder if no action is taken. It is their duty to get it signed by the employer.
