Tragic Workplace Accident: Can a 7-Day Employee's Family Receive Pension Benefits?

Rajangadekar
Suppose an employee joined on 01/01/2012 and died on 07/01/2012 in a fatal accident at the company while working. His PF was deducted from his wages and deposited in the PF Office. It is shown in the Annual PF Return as well. His service was only for 7 days. Will his nominee be eligible to receive pension benefits?

Any person who has worked for even one day and died, their family is eligible for PF pension. The employee becomes a member of EPF on the day of joining. The nominee or dependents of the employee can submit Form-20 to receive the PF contribution amount, Form-10 D for Pension, and Form 5 for EDLI Benefit. You can also apply for funeral expenses and dependent benefits from ESI. For ESI dependent benefits, they will be given only when the employee has worked for the minimum period as mentioned in ESIC. Please check with your PF & ESIC authority for the process since it has been more than 9 months.

Dear John Sebastian Peter,

I need to know if, in place of the birth certificate of children of a deceased person, a BONA FIDE CERTIFICATE issued from the school can be valid in such a case or not. Kindly clarify from your end.
