Is It Too Late to Issue Backdated Appointment Letters After 10 Years?

Dear All,

Can anyone guide me if there has been a large number of employees who were not issued appointment letters at the time of joining, but all formalities such as PF, ESI, Gratuity, and everything have been paid by the employer, then is there any problem in issuing the appointment letters now? Could the delay be as long as 10 years?

Can the appointment letter be made backdated and issued now?

Some of the employees who joined 10 years ago might still be with the company at this time. Therefore, issuing appointment letters backdated is not advisable. Appointment letters should be issued to current employees with the current date, including a clause to address any delays in issuing the appointment letter.

Well, if the employees have not been issued appointment letters in the past, it can be a serious concern in the future with many things, but there is no need to continue with this culture/system/rule of not issuing. So, you can issue, and even must issue, an appointment letter to employees with accurate and appropriate terms and conditions of employment. I wonder if you have any lacks in your organizational policies, and if required, you can work on the development of your policies to create a good system.

Like the other members mentioned, it's okay to issue 'current-dated' Appointment Letters with the relevant clauses incorporated.
