Delay Appointment Letter

ashishks007
Dear All,
Can anyone guide me that if there have been a large number of employees who were not issued appointment letters at the time of joining, but all formalities such as PF, ESI, Gratuity n everything has been paid by the employer, then is there any problem in issuing the appointment letters now? The delay may be a long as 10 years?
CAN THE APPOINTMENT LETTER BE MADE BACKDATED N ISSUED NOW?

Hi,
Some of the employees might be left who had joined 10 years before, by this time. Hence, It is not advisable issuing appointment letter in backdated. It can be issued to the present employees with the current dated, by capturing the clause for delay in issuing appointment letter.

Well if the employees have not been issued the appointment letters in past, can be a serious concern in future with many things but there is no need to continue with this culture/system/rule of not issuing. So you can issue, even must issue an appointment letter to employees with the accurate and appropriate terms and conditions employment. I wonder you having lacks in your Organizational Policies and if required can work on development of your policies to make a good system.

Hello Ashish,
Like the other members mentioned, it's OK to issue to 'current-dated' Appointment Letters with the relevant clauses incorporated.
Also, pl see this thread--this issue is also being discussed elsewhere. You can also find a draft copy of the Letter.
