Is It Legal to Prorate My Joining Bonus Repayment After Resigning Early?

I joined a multinational company (MNC) in Bangalore 6 months ago and am currently still on probation. I received 3 lakhs as a joining/sign-on bonus after taxes. Now, I am resigning from the company. According to my appointment letter, I will be required to repay the full 3 lakhs if I leave the company within 1 year. However, I am requesting the company to prorate the return of the joining bonus as I have already worked for 6 months and it has been taxed.

Could you please advise me on whether this request is legal according to labor laws or any other relevant regulations?

Legally Binding Contract and Pro-Ration Appeal

As there is a contract that clearly states the terms and conditions, and you have also accepted it, it is, therefore, a legally binding contract. The company has every right to execute as per this contract.

Having said that, it is also not harmful to appeal to HR with your suggestion of pro-ration, treating it as an exception.
