How Can I Get a Correct Appointment Letter After Leaving a Company with Incomplete Documentation?

I worked with a company that sent me the offer letter upon joining but didn't provide me with the appointment letter. They hadn't completed all the formalities and were paying the salary in cash. I had some personal issues and left the company after 5 months with a proper notice period. However, I did not receive any acceptance letter, nor were they willing to provide me with a relieving letter.

After 2 months, I received another offer from the same company and decided to re-join due to a better salary offer. This time, I was given the responsibilities of a team lead. Even then, they did not provide a re-joining letter or any other company benefits (still paying salary in cash). After 6 months and several arguments, they agreed to provide the appointment letter. To my surprise, the letter they provided mentioned my previous designation and an incorrect joining date (6 months later date).

Subsequently, I decided to resign. After two months, I received a very good offer and chose to take that job. The next morning, I informed my manager and VP about my decision and expressed my inability to serve the notice period due to the better offer. My manager instructed me to hand over my responsibilities to colleagues, get it signed, and then I could leave. I agreed, submitted my resignation that evening, handed over all responsibilities, but upon requesting relieving and salary, they refused, citing non-completion of the notice period.

Furthermore, I did not receive the 21 days' salary for the month. The issue now is that I am unable to showcase my experience with this company as the appointment letter contains an incorrect joining date.

Please advise on how I can obtain the correct letter as it is essential for my records. I provided significant help when they needed it, but they seem unwilling to assist me.

I am really surprised to know that your prior experience was so bad with the company, yet you joined again. If you have the following supporting documents available, I would suggest filing an FIR and then lodging a complaint in the Labour Court:

- E-mail communication with HR/Employer
- Your appointment letter (irrespective of the date of joining)
- Salary acknowledgment duly signed by you (Optional)
- Any witness (Optional)

Things can also be sorted out if someone from the labour court/lawyer who is known to you discusses the matter with your employer or writes your complaint online.

I would like to inform you that relieving documents will be required throughout your career.
