How Do You Handle Employees Taking Excessive Leave Without Valid Reasons?

Hi, I am Khushboo. I work in a private limited company related to travel. We provide 21 paid leave days to all employees in a year. However, many employees are exceeding this limit and taking nearly 50 days of leave in a year without any specific reason (such as maternity or major injury). I would like to know if there is a policy regarding the maximum limit of leave that an employee can take in a year.

To avoid these complexities, you should establish a leave policy. If there are any policies in place, everything will be alright. Once you schedule the maximum paid leave (PL), if they exceed that, you shall deduct their salary.

Thank you for your valuable response. We have a leave policy as follows:

"Leave Policy Overview

1. You will be on probation for a period of three months during which you will be entitled only to 1 day of casual leave per month. Upon satisfactory completion of probation, you will be confirmed in the regular service of the company.

2. You will be entitled to all benefits and perquisites as per the company's rules for employees in your category. Upon confirmation, you will be entitled to twenty-one days of annual leave (14 earned and 7 casual), which will be provided on a pro-rata basis."

Additionally, we deduct an employee's salary if they exceed the specified leave limit. We are considering implementing additional rules to ensure that employees do not take excessive leave.

In that case, you should educate and train them. You may also counsel and advise them gently, as it is not advisable to take more leaves. Everything will reflect in appraisals and promotions.

Maximum Leave Policy

The maximum leave one can avail in a year is the maximum leave permitted by the company (all types of leaves). Beyond this limit, the leave may be treated as Leave Without Pay (LOP), except in the case of maternity leaves or some special leaves.
