Now, can the CGM or GM be considered the principal employer as the overall in charge? The job awarding and execution are done at the DE/SDE/JTO level and vary from one DE to another DE in nature as well as quantity. DGM/DE/SDE/JTO do not have any financial power. Financial power lies with GM/CGM, and all policies regarding contract labor are controlled centrally by the CGM.

The principal employer is the company, not any employee of the company. They are simply drivers of the company, with the company itself being the principal employer.

How can a GM or a CGM be a Principal Employer? The term "Principal Employer" is given to the organization that provides third-party contracts. In this case, if the contract labor is hired through a contractor, then the hiring entity is called a Principal Employer (PE). Policies and contracts can be managed by the GM/CGM. In your case, "BSNL" is the PE.

According to Section 2(g)(i), the Principal Employer in relation to any office or department of the Government or a local authority means the head of that office or department or such other officer as the Government or the local authority, as the case may be, may specify in this regard. BSNL is a PSU, wherein the Principal Employer is the head of the establishment/location who has obtained an RC in his name. The RC is issued to government offices/departments, including PSUs, in the name of the person holding the position of CEO/Executive/Executive Engineer/HOD, etc.

Registration and Licensing Process in BSNL

Registration is made in the name of the organization. Here, BSNL will handle the registration or licensing process. CGM -> GM -> DGM -> DE -> SDE -> JTO are all workers.

Yes, BSNL is the apex authority. It can be anyone who is appointed by the top management, either the HR head, GM, or anyone from middle or top management.

Good question! Let me tell you, any employer who has engaged the workers for the work to be done is called the Principal Employer. As per the CLRA Act, the "Principal Employer" can be:

(i) In relation to any office or department of the Government or a local authority, the head of that office or department or such other officer as the Government or the local authority, as the case may be, may specify in this behalf.

(ii) In a factory, the owner or occupier of the factory and where a person has been named as the manager of the factory under the Factories Act, 1948 (63 of 1948).

(iii) In a mine, the owner or agent of the mine and where a person has been named as the manager of the mine, the person so named.

(iv) In any other establishment, any person responsible for the supervision and control of the establishment.

In this state of affairs, the signing authority will be your CGM.
