He could not get licenses in his name. Please refer to the details for the license at your regional SP office. Also, refer to the Bihar Private Security Agency rules published by the Home Department of Bihar on 22/10/2011. I can give a small brief to get a lead.

Steps to Register as a Private Security Agency

The following simple steps need to be followed to get registered as a Private Security Agency:
• Register your business venture after checking the availability of the desired name.
• Register for Income Tax and other statutory authorities, i.e., applying for basic tax numbers:
i. PAN
ii. TAN
iii. Service Tax
• Register your domain name.
• Open a current account with the bank.
• Obtain a license under the Private Security Agencies (Regulations) Act, 2005 (PSRA).
• Register under various labor laws.
• Register under the Shops & Establishments Act, 1948.
• Arrange for guards and security equipment.

I want some more clarity on it—should the PAN, TAN, etc., be arranged first or after taking a license under PSRA 2005?

Based on the license copy, you can apply at the same time. If the service tax and other local taxes are applicable, you must discuss with a local tax consultant for state taxation details.

PRIVATE SECURITY AGENCIES ACT 2005 Overview

Everything is clearly mentioned in the PRIVATE SECURITY AGENCIES ACT 2005. The Act states that a security services business can only be started when the necessary license is obtained.

Steps to Obtain a License

For getting the license, the mandatory requirements are:
- Police verification of owners/employees if you are likely to get a contract, for which you must have a copy of the purchase order of the prospective contract.
- Sample of uniform, photographs of guards from four angles.

It is therefore clear that to get a prospective purchase order for supplying security guards, one must have a license under Shops & Establishment, Service Tax Registration, Professional Tax Registration, PF code if more than 10 guards/employees, ESIC Code if more than 20 employees, and PAN number.

However, if the necessary number of guards is less than required for PF or ESIC norms, the registration numbers for PF/ESIC can be obtained later and submitted within three months after getting the PSAR license. Necessary documents, as mentioned above, need to be attached with the prescribed application form and submitted along with fees as mentioned to the commissioner's office.
