Confused About TDS Deductions on My Salary: Can I Get a Refund?

sudiptosen2007
Hi all, I am getting 13,350, and the finance team is deducting TDS. After deduction, I am left with 12,015. I want to know how they are calculating TDS from my salary. I believe TDS deduction should not be applicable because my CTC is below 2 lakh per annum.

Query on TDS Refund

Also, is there any way to reclaim all the TDS deductions already paid?

Regards,
sathdil
Please check with your HR, as you mentioned that your CTC is below 2L, which never falls under the Income Tax bracket.

Your salary, as you mentioned, is ₹13,350/-. In such a case, TDS will not be deducted because your salary per annum is ₹1,60,200/-, whereas TDS up to ₹2,00,000/- is nil for the Financial Year 2012-2013 and ₹1,80,000/- for the Previous Year 2011-2012.

Dear Gentlemen,

You have mentioned CTC is 1.8 lacs. If you are a salaried employee, then TDS is not applicable. If you have been appointed as a consultant, then TDS will be applicable. Kindly verify your appointment letter.

Ravi.

There is no question of TDS for ₹13,350/-. Check with your HR, and if you are a consultant, they will definitely deduct TDS. If you are a salaried employee, then there is no question of TDS.

If you are working as a professional, then you are not being treated as an employee. Instead, they are treating you as a consultant. The TDS rate for consultancy is 10%. In this setup, there is no employer-employee relationship.
