Notice Period Dilemma: How Can I Handle My Company's Refusal to Shorten It?

Notice Period Dilemma

I joined a consultancy on 1st March 2012 and signed an appointment letter stating that my notice period is 1 month. Now, I have received a job offer from another company and I wish to serve only 1 week of notice period. I am willing to buy out the remaining notice period and hand over my responsibilities to my backup. However, my company is not willing to reduce my notice period.

What should I do in this situation? Please advise me.

Try to speak to your HR and Line Manager and convince them amicably for your early release. Also, speak to the HR of the new employer to postpone your DOJ. Your current employer can't stop your F&F and Experience certificate as you are ready to settle the shortfall of your notice period. However, they can delay it to trouble you. In such a situation, your new employer will ask for relieving docs, and your current employer will keep on delaying. You may also be issued warning letters. Background verifications are being done in every organization these days, so your new employer may approach them for feedback, and they may share negative feedback about you. Therefore, I would advise you to peacefully sort it out and respond to every mail you receive from them.

Dear Satpreet, thank you. I have had a discussion with my director as well. At the time of joining, he told me that I could take an early release if I got a good job offer; now he is also denying it. (I do not have written proof of this conversation). They told me that I have to complete a 30-day notice period and also "wawl" on me.

Sometimes, some people are like that. Just try to negotiate with your present employer. If you have a replacement (backup), then you now have all the rights to negotiate for early relief.

If you inform your current employer that you will be joining after one month and discuss the problem you are facing, your previous employer may not be willing to compromise based on your position. It is important to communicate with your current employer, as your previous employer may not release your full and final experience certificate.

You can find a solution to your problem by deducting the days left that have not been served concerning the notice period. Let's have a word with your employer and sort out the problem.

One more thing I want to share is that he is misbehaving with me. I have left the organization, and now I am not going to the office. They are unwilling to give me my release letter and my one-month salary. Please guide me on what I should do next because they have informed me that they are planning to take legal action against me.
