Mr. AlGore is a driver for a company. The Company assists Mr. AlGore financially to buy a truck and Mr. AlGore has to paint the truck with the company colors. Mr. AlGore has to wear the company\'s uniform and he has to be on call on weekdays. Mr. AlGore get paid based on mileage rate for the deliveries he completed. Is Mr. AlGore and employee or Independent contractor?

As per your above described problem Mr. AlGore seems to be more as an Independent Contractor since he is been paid on mileage basis. If the company wants him to be an Employee then the company would have given him monthly salary rather then mileage basis.The reason why I support him as an Independent Contractor is because the company is asking him to buy the asset(truck) and is asking him to work for them so if anything happens to truck would not be a company problem since its Mr. AlGore property. We can also see that company assist financially but is paying on mileage basis so it mean its a loan sort of help according to me. So this is what I feel in the above case study.
