How Many Earned Leave Days Can You Take at Once and What's the Process?

I am Sanjay Gupt from Jamshedpur. I have a doubt about the Earned Leave (E.L.). Please confirm how many days of earned leave are given to workers and staff in one month at one time. Also, what is the procedure for taking this leave?

Those who are in continuous service for the preceding 12 months (should work not less than 240 days) are eligible for 15 days of E.L. during the subsequent year. If a person joins in the middle of the calendar year, they are not eligible for Earned Leaves until the completion of 12 months of service.

1. E.L. can be utilized three times in a year.
2. Leave should be applied for one week in advance.
3. Leave can be encashed for 8 days in a year. However, the company pays 15 days' wages/salary in lieu of Earned Leaves at the time of Pongal, subject to the availability of 15 days' leave. Otherwise, the balance leave is allowed to be encashed.
4. Intervening holidays/weekends will not be treated as Earned leave.

In addition to the opinion of respected Sharmilaji, I wish to add the following. If it is a factory covered under the Factories Act, 1948, please refer to Chapter VIII, Sections 78 and 79 on Annual Leave with wages, wherein (Sec. 79, subsection (i)) it is mentioned that "if an adult, one day for every twenty days of work performed by him during the previous calendar year."

Also, enclosed please find a draft notice and procedure which may help you in formulating leave rules.

Thank you very much for your answer, but I still have a doubt. If an employee is appointed by the company in October 2012, will he/she be entitled to 3 months of earned leave, meaning 3.9 days of earned leave?

Calculation of Earned Leave

3 x 26 = 78 / 20 = 3.9 days to be carried over to the next calendar year, 2013, for enjoyment.
