Maternity Benefits Without a Policy: Can Employees Still Claim Their Rights?

If an organization does not have any maternity policy, will the act be applicable? Can an employee ask for maternity benefits? Please guide.

Yes, very much. It is mandated as per the Factory Act as well as the Shops & Commercial Establishment Act. No employer can stop an employee who is eligible for maternity leave.

In the case of an establishment covered under the Shops and Commercial Establishments Act, there should be at least 10 employees in order to make the Maternity Benefit Act applicable.
