Dear All,
In case an organsiation does not have any maternity policy, will the act be applicable? Can an employee ask for maternity benefits? Please guide.

Yes very much. It is mandate as per the factory act as well as Shops & commercial establishment. No employer can stop if employee is eligible for maternity leaves

In the case of an establishment covered under the Shops and Commercial Establishments Act, there should be at least 10 employees in order to make the Maternity Benefit Act applicable.
