Maternity Leave and Public Holidays: Is She Entitled to the Day Off?

Please tell me if a lady employee on maternity leave, during which a government-gazetted holiday like Independence Day falls, is entitled to the holiday. Is she eligible for the holiday, yes or no?

In my opinion, during maternity leave and other extended leaves, holidays or national holidays do not provide additional benefits. This is because all the benefits of holidays and national holidays stem from our actual work, not from being on leave (as of the present day). Therefore, there is no dual benefit associated with taking leave or maternity leave.

It depends on the specific rules of the company. Normally, in most organizations, if any intervening public holidays occur during a long leave period, they are included within the period of leave taken. However, in some organizations, they are excluded when calculating the leave period.

As far as I know, all the holidays that fall during the maternity leave period are included. For example, if a lady is eligible for a 90-day leave from 20th September, you have to count 90 days from 20th September; Sundays and holidays are counted.

Dear Harnek,

As per the rules, we have to pay employees on leave because 15th August is a national holiday. For a person in continuous service, we will pay them for that day. Therefore, it will be considered as leave.

Answering the question specifically related to maternity leave, any national holiday that falls between the period of leave will be counted as maternity leave only. It won't be considered a national holiday and therefore will not be excluded when calculating the days for maternity leave.
