I am an HR professional working in a manufacturing firm and had to terminate an employee in the admin department without notice due to inappropriate behavior and poor performance. Over the past months, she had been warned for low performance, but since there was no HR personnel, she did not receive any warning letter.

Legal Action and Compensation Query

Can legal action be taken by the employee if she did not complete 6 months with the company? Please provide me with the appropriate solution to draft a reply email to the employee who is claiming compensation for not being given a notice period for termination.

Handling Employee Termination Without Notice

No legal action can be taken if the employee leaves the company before completing 6 months. It is better to issue a fresh notice explaining the wrongdoing committed by the employee and ask for their response before considering termination. Once they provide a response, if it is deemed unsatisfactory, then termination can be pursued.
