ESI Contirbution At The Time Of Maternity Leave

Dear all,
When women employees in Maternity leave, statutory payments are deducted or not (like PF ESIC and PT) from their salaries?

Dear Sri. Vinay Kumar,
When the member is on maternity leave, you are not paying any salary for that period, how you will deduct PF & ESI? You should not deduct any statutory dues.

I think, the question is related to Maternity benefit payment. The ESI and EPF, P.Tax etc. are
required to be deduct from Maturity benefit i.e salary / wages payable for 81 days. or + one month extra
whatever it may be.
If the concern staff have taken more leave than the prescribed in law and if it without pay, then obviously
statutory deductions not arrived and applicable.

How you are going to pay maternity leave salary to women.They are covered under ESI.You have to get leave certificate from employee which was given by ESI DOCTOR.
In this regards, you can not pay salary for not working.If salary not paid, deduction question does not raise

Dear Vinay,
There are two aspects where we need to focus.
1) If the employee is covered under ESI (i.e her over gross is less than 15000/-), then however she is deemed to claim the wages/salary from ESI as per the statutory norms.
2) If the employee is not covered under ESI (i.e her overall gross is greater than Rs. 15,000/-) then its the responsibility of Company to pay wages/salary.
Note: However if the salary is processed then automatically her statutoey deductions need to be deducted.
Kindly correct me if I am wrong.
