Legal Transfer and Transfer Policy Concerns in Joint Ventures like NTPC and KBUNL

ahmadsaleem
I was transferred from NTPC (a CPSU) to the joint venture between NTPC and BSEB (known as KBUNL). Is it legally possible to make such a transfer from a CPSU to a joint venture between the CPSU and its joint venture?

Thank you.

Hello Ahmad,

Why not?

Please check your Appointment Letter of NTPC—there would be an appropriate clause about transfer/deputation of services.

By the way, what's the reason for your hesitation to report @ KBUNL?

All the best.

Hi Ahmad,

Taj Sateesh is right. It is legal. Unfortunately, NTPC also does not have a proper transfer policy, and the Executive Association has not been able to establish one. Without a robust transfer policy in place, transfers and postings will be arbitrary. You may not have any other option but to join.

As long as your interests are protected, I don't think there is any problem. In fact, JV size is not as big as NTPC, and the real performers can shine.
