If the contractor who is engaging his employees in your establishment does not have ESI or EPF registration of his own, the responsibility of providing coverage to his employees will fall on you. As the Principal employer, you must register the contract employees under your company code and pay the contributions along with your directly employed employees. Subsequently, you can collect the amount paid from the contractor by deducting it from the amount payable to him on a monthly basis.

Responsibility of Enrolling Employees in ESI and PF Schemes

It is the duty of the contractor to enroll the employees under the ESI and PF schemes. If your contractor did not enroll the employees, then it is your responsibility to enroll them since you are the principal employer, and you can deduct the amount from the contractor.

How can we obtain ESI and PF sub-codes? Can we register PF and ESI under the name of an individual contractor through a Labour license, or does he need to register under the Shop and Establishment Act?

PF subcode can be obtained in no time. Hope you know that an establishment has to register with the PF department website, and contributions should be made by generating a challan from there.

So, first, register yourself online with the PF website (if not done earlier). Then, using your login ID, you can generate a subcode for any of your branches in any part of India. I need to check whether a similar facility is available in ESI.
