PF & ESI Applicability - Pf Esic

we have certain Independent Transcriptionist professionals who work from home and paid base on lines ... can any body clarify whether such Indipendent Transcriptionist professionals can ever be categorised for PF & ESI applicability purposes ....
Note:- they can work with multiple companies also

1st its dependence on Appointment letter you have given and
2nd If any body working more then one company then PF & ESI will not be applicable.

Whether he/she is employee of the organisation? As you told as payment is based on the number of lines translated I feel it might be as outsourcing the process. Then you shall consider him/her as consultant. In that case you shall pay as professional fee and no need of ESI & PF.

I have a query why is that the ESI share of worker deducted of his minimum wage? Why is it not paid b the employer since cost of living is high and poor worker cannot afford to lose small change?

Hi Jaya,
In any given situation (Medical Condition), the employee can produce a medical certificate proving his fitness to work and can apply for a work from home cause. Rather, it depends on the employer wether to permit the employee work from home or not.

If any person is involved in your companies pay roll then all that employees has to be enrolled under ESI and PF
