Facing Sudden Job Termination at Tata Enterprise: Can the Labor Court Help Me?

Dear all, please guide me on what I can do, or whether the labor court will provide justification. I am working at Tata Enterprise in Mumbai. A few days ago, we received the organization's restructure chart, and unfortunately, my name is not on the list. After one week, I received a termination letter stating that my performance is not satisfactory, and the company is relieving me with immediate effect. I need your help.

Without giving a notice period, the employer cannot terminate the employees working in the organization. There are certain rules for termination. First of all, please provide us with full details (your date of joining, whether you are confirmed or on probation) so that we can assist you.

Termination Procedures

Second, no employer can terminate any employee immediately by just issuing a letter citing non-performance. There is a procedure for these actions where the employer has to issue a letter to the employee regarding his/her poor performance first. If the performance given by the employee, even after the notice/warning letter, is found unsatisfactory, the employer can ask the employee to leave with a certain notice period according to the terms and conditions of the appointment letter agreed upon by both the employee and employer. Immediate termination cannot take place just by observing poor performance of any employee.

Dear Sir, I was in distribution, and we are 8 people, including me. I was the only one who was terminated by the Head of Department (HOD). The HOD has taken it personally.
