Contractual Labor Concerns: What Can Employers Legally Do About Training and Data Storage?

Arun Saini
Hi all, just want to know as the principal employer, how much of the following activities I can engage in with contractual labor and how much data I can legally store in my systems regarding their training, salary, and performance appraisal. Questions like can I really conduct training of contractual labor, their performance appraisal, rewards, and recognition?

With reference to the Contract Labour Act, I would like to point out that while you can showcase the training provided to contract labor, you may not be able to include them in the performance appraisal process since you are not the direct employer.

I thought that if you engage contract labor through a contractor, then you need to maintain legalized documents, i.e., license, payment of wages, bonuses, fringe benefits, etc. The contract labor license is very important for the employer's safety in case anything goes wrong. If there is no valid license or agreement with the contractor, and something fails by the contractor, the employer is primarily responsible.
