Notice Period Confusion: Do I Need to Serve 3 Months After Resigning in Germany?

Hi All, I joined HCL Tech in Bangalore and was subsequently transferred to HCL Germany. In HCL Germany, the notice period is one month, while in HCL India, it is 3 months. Last week, I resigned from my job in HCL Germany (just two weeks before the scheduled return to India), and I'm willing to serve the 30 days' notice period. Now I have been told that as soon as I reach India, my notice period will increase to 3 months. Can someone please let me know if this is valid as I have resigned while in Germany?

Please check the agreement you signed before your transfer to Germany. Check for the jurisdiction. I believe you have an intra-company transfer. Based on my experience, employees are generally kept under the jurisdiction of the appointing country. So, in your case, you have to serve 3 months.

If your appointment terms according to the transfer of employment state that you have to serve only a one-month notice period before leaving, and you are already serving your notice period as you have resigned, they can't impose a three-month notice period on you. I'd suggest you refer to your appointment/transfer of employment letter for the terms and conditions and proceed accordingly.
