Confused About Double Salary Deductions During Notice Period? Need Guidance!

My name is Bhajneet Singh. I was working in a Pvt Ltd organization in Sonepat.

A few days back, due to some reasons, I resigned in writing with one month's notice period as described in my joining letter. During the notice period, I was on leave for 6 days without intimation as the EL or SL are not provided in the organization. In my salary, 6 Leave Without Pay is shown (i.e., deductions were made), and in the full and final sheet, they told me I also have to bear an extra 6 days deduction in F&F as I was not present during the notice period. By this, they deducted a total of 12 days' salary for taking 6 leaves during the Notice Period. When I asked them about the extra deductions, they said it is as per the law.

You are requested to please guide me on the above matter.

Leave Deductions During Notice Period

During the notice period, only Earned Leave (EL) cannot be availed as per a few State Shop & Establishment Acts. However, an employee can avail Sick Leave (SL) or Casual Leave (CL).

There is no law that provides for the deduction of 12 days' wages for taking 6 days of leave. If you were on leave without intimation, they might have imposed it as a fine if it is mentioned in their Standing Orders. You can still speak to them or seek help from the Labor Inspector.

As per the appointment letter, if you do not serve the notice period as mentioned, the company might deduct your salary based on those terms. Sir, first, you should thoroughly review your appointment letter to understand the specific conditions and clauses regarding notice period obligations and related deductions.

I assume that 6 days were unpaid for the simple reason of being absent without any paid leave in your quota. Another 6 days deduction would probably be due to the 30 days' notice not served in full as you were absent for 6 days, so they deducted 6 days' pay for short notice served. Check the appointment letter; it might be written there that during the notice, a person has to work on all the open days. In case of dissatisfaction, you can file a complaint with the local labor officer and hope for the best.
