Dear Seniors, please let me know if there are any compulsory legal provisions for women employees that must be provided by the employer. I am aware of the Maternity Benefit.

Equal Remuneration Act
Apart from the Maternity Benefit Act, another important legislation is the Equal Remuneration Act. According to this act, there should not be any discrimination in wages for employees within the same category based on their sex.

Prohibition of Night Shifts for Female Employees
Furthermore, the prohibition of working hours for female employees during night shifts requires permission from the relevant authorities as per the State Shops & Establishments Act, Rules, and Factories Rules. These regulations apply to both male and female employees equally.

Dear Vijaya,

Under a few labor legislations, females have been protected from any kind of exploitation as they hold a special place. According to the Factories Act, women are prohibited from working between 7:00 pm and 7:00 am, which includes night shifts, deployment on hazardous processes, and operating dangerous machinery. It is mandatory to provide females with separate toilets, washrooms, lunchrooms, rest areas, crèches, lockers, etc.

Eligibility for Paid Leave

In order to calculate 240 days for eligibility for paid leave, maternity leave should be taken into consideration. Protection is also provided under various acts such as the Mines Act, Plantation Act, Transport Act, ESI Act, Equal Remuneration Act, Motor Transport Act, and many more legislations. It is essential to thoroughly review the detailed provisions of each Act.
