Rehired Employee Earning Above ₹6,500: Should We Continue EPF Contributions?

EPF Contribution Query for Rehired Employee

Ours is a private limited company. I would like to know the instructions of Form 11 under the PF Act. Recently, one of our employees left our organization who was covered under EPF. After one month, he rejoined our firm, and now his salary is above ₹6,500/-. Since he is earning more than ₹6,500/- per month, can we exclude him from EPF contributions, or is there any law under EPF to continue him under EPF rules?

Thanks & regards,

Since he has rejoined after one month, there is no possibility of his withdrawing the PF dues. Therefore, you cannot exclude him even if his PF qualifying salary exceeds Rs 6500. If you provide him with Form 11, he can only write that he was previously employed in an establishment to which PF applies. In such a scenario, you cannot exclude him from PF.
