Applicability of Form - D of Equal Remunerations Act in companies with less than 10 employees

In Companies where the total number of employees is less 10, would FORM - D of the Equal Remuneration Act, 1976 be applicable?

We have been registered under Shops & Establishments but am doubtful that Form D is applicable or not? as we have not maintained. If so, the form is available readily, but after filling the form, who should sign on that or do we need to go and submit it in labour office?
