Is My Factory Exempt from Section 7-A(3) or Involved in Hazardous Processes?

Dear All,

Under A.P. Factories Rules, 1950, the form prescribed under Sub-Section (1) of Section 7 is as follows:

12. Notice of Change of Occupier or Manager:

1. The occupier of every factory shall, within seven days of any change in the manager of the factory, send notice thereof in Form No. 2-A to the Inspector.
2. Every new occupier of a factory shall, within seven days of the change of occupation, send notice thereof in Form No. 2-A to the Inspector.

12-A. Exemption from Section 7-A(3):

All factories employing less than three hundred workers are exempted from the provisions of Subsection (3) of Section 7-A of the Act. This exemption does not apply to cases where Chapter IV-A relating to hazardous processes applies.

The exemption is applicable to Galvanizing & Fabrication of Tower Structures Company where we have only 250 people employed. How can I determine if my company is involved in hazardous processes?

Please advise me.

Please check the Factories Act in Andhra Pradesh. The schedule is provided in the book.

There is a schedule appended to the Factories Act and also the Factories Rules of that particular state. You need to check whether the process of galvanization and fabrication falls under hazardous activities or not.
