Confused About ESI and Workmen's Compensation Rules for Remote Construction Sites?

Dear all, someone mentioned that if the construction site in an EPC company is 10 km away from the city (Pan India), then ESI is not applicable, and the Workmen's Compensation Act applies instead. I am not aware of this concept. Please help me understand the exact rule that applies.

If ESI is applicable in an area, can we choose to opt for the Workmen's Compensation Act instead of ESIC?

The information you stated is partially correct for point one. In an area where ESIC is applicable, for employees whose gross pay is not out of the ESI limit range, it is mandatory to register those employees under ESIC.

My suggestion would be to go for the ESIC registration for all those who come within the range and additionally extend all employees benefits under the "Group Insurance Coverage." You may approach any General Insurance company for this scheme.

As for the second part, if the construction site is 10 km away from the city in an EPC company in Pan India, ESI may not be applicable, and the Workmen Compensation Act would apply instead. If ESI is applicable in an area, can we opt for the Workmen Compensation Act instead of choosing the ESIC?
