Is My Company Breaking the Law by Losing My Document and Misleading About Office Location?

Hi Sir, my current firm has lost my original 10th class mark sheet, which they had asked for as proof of the contract. They mentioned that I would be placed in the New Delhi office; however, I was placed in Gurgaon, which is in Haryana. Is it correct that besides stating that I will be based in the New Delhi office, I am actually based in Gurgaon? Even though I understand that the New Delhi office can be located anywhere, can it be placed in another state? I am supposed to work at the New Delhi office, which is located in Haryana; does this make sense?

Integrity and Legal Concerns

What laws have they broken apart from this integrity issue, and what could be the outcomes of this situation? In the contract, they stated that I would have to work for one month and forfeit my full salary if I leave before a year.

I decided to quit, and then I was informed that I could collect my document at the time of full and final settlement. When I asked for the document as I needed to present it elsewhere, I was told that the document has been lost.

Unprofessional Handling of Employee Certificates

The attitude of the company authorities is very astonishing. After having lost a certificate of an employee, the company is simply saying that it is lost! This is really unethical and unprofessional.

First of all, the company should not have collected the certificates in the original as a surety. If collected, it should have kept them safe, and if lost, it should have the courtesy of making it available to the employee at any cost. The attitude of the company that you will receive everything along with full and final settlement is really upsetting as well.

Therefore, I would say that you should lodge a criminal complaint against the company at the local police station. Anyway, if you want to apply for a duplicate, you should have a copy of the FIR. Therefore, do that.

Hi Madhu, I was really looking forward to this answer. In any case, I will have to lodge an FIR to get a duplicate issued. You made my day. I have a meeting today with them. As per the contract, I was supposed to work for a month without my salary. Today, I will ask for my salary and for a letter from them stating that the document has been lost. Thanks again, Madhu.
